1. Services

1.1 Big Sky Picnics provides luxury picnic package experiences in Kalispell and surrounding areas. 

1.2 We’ll try to include your wishes, but our services are pre-packaged. We have the final say on aesthetic judgment and quality. For a custom event, let’s collaborate. Additional fees apply for the event planning services.

1.3 Please do not be late to your picnic. Our picnics are time and daylight sensitive, and we will not be able to extend your time if we haven’t pre-arranged. Your time start at the set scheduled time.

1.4 Please do not leave your picnic setup unattended for. If you need to leave early please contact us and we will return to your locations to secure set up.

1.5 Some locations may require a permit so please inquire into that before booking.

1.6 We reserve the right to refuse service to anyone.

2. Weather and Location

2.1 For safety reasons and to ensure a positive experience, we may advise a location change if there are rainy weather, strong winds, heavy snow. If we advise against holding the picnic due to these conditions, we may reschedule for a later date.

2.2 If we advise of unfavorable conditions and the customer still wishes to proceed with the picnic, they accept all risks and liability for any damages or losses. 

2.3 Big Sky Picnics reserves the right to cancel or reschedule the picnic experience at any time if we feel that the weather poses a threat to the safety of our clients and staff. In such cases, we will notify the client as soon as possible and work to reschedule the picnic experience for a later date that is convenient for both parties.

2.4 If unexpected winds cause the Bubble Tent to become unstable, please call me immediately so that I may come help secure it and/or take it down.

2.5 If the selected location is a public space, such as riverside or park, Big Sky Picnics will do their best to find a great place that is intimate and suitable for your event. However, please note that we cannot guarantee the availability or suitability of public locations, as they are subject to various factors beyond our control.

2.6 Big Sky Picnics will not be responsible for any injuries that may occur at any location for any reason.

3. Payment

3.1 To secure your booking, Big Sky Picnics requires a non-refundable deposit of 50% upfront. The final payment is due 42 hour before the event. Event setup will not occur without full payment prior. In the event of last minute booking full payment is due upon booking.

3.2 Payments and deposits are non-refundable to ensure we can provide the best service possible. We do not provide refunds. Once a payment or deposit is made, it is non-refundable.

4. ID Requirements

As part of our standard procedures, we may require a valid form of identification to be presented on the day of the event, to ensure that it corresponds to the details provided in the booking form. This is intended to enhance the safety and security of all attendees and to prevent any potential fraud or misrepresentation.

5. Rescheduling, cancellation & refund

5.1 Bookings secured with a deposit may be rescheduled 24 hours before due to bad or severe weather or a change of mind.

To clarify, “bad weather” for rescheduling purposes does not include cloudy days or light, intermittent rain that doesn’t disrupt outdoor activities. Our definition focuses on conditions that pose safety risks or significantly impair the outdoor experience, such as heavy rain, thunderstorms, severe winds, snow, extreme heat, and poor air quality. Cloudy skies or mild weather variations, which often provide pleasant temperatures and protection from direct sunlight, do not qualify as bad weather under our policy. We encourage our clients to embrace the beauty of nature in all its forms, with the assurance that we prioritize safety and comfort for a memorable outdoor experience.

5.2 Big Sky Picnics does not offer refunds due to change of mind or bad weather. In the case of bad weather, we can set up your event indoors or reschedule for another date.

5.3 Please note that the deposit payment made for our services is non-refundable.

6. Equipment

6.1 Please do not sit, stand or move our equipment. Each glass, plate, fork, knife, etc., are sanitized. 

6.2 You are responsible for our items during your allotted time. Please treat our equipment with care.

6.3 Please do not light our candles. They are for display only.

7. Damages Policy

The Customer shall pay for all equipment damage or loss however caused during the event. Suppose there is any damage or loss of goods such as picnic tables, Bubble tent, utensils, boards, bowls, plates, glasses and cups, rugs, table linen, napkins, etc. In that case, the person booking will be charged accordingly and invoiced after the event. Pricing is available upon request.

7.1 Damage deposit of $50 is required to rent the Bubble Tent. You will not be charged if Bubble Tent is returned undamaged and smoke free. There is NO smoking allowed in the tent.

8. Advertising

8.1 Big Sky Picnics have the right to use all photos taken during the event for advertising purposes.

9. Alcohol

Big Sky Picnics are not responsible for any consequences of alcohol consumption. –  REPHRASE (IS NOT HELD LIABLE FOR ANY POSSESSION OF ALCOHOL OR OTHER SUBSTANCES. WHAT YOU PROVIDE IS UP TO YOUR DISCRETION, AND WE ARE NOT HELD RESPONSIBLE FOR ANY CONSEQUENCES.) It is up to you the client to verify the rules and regulations of alcohol consumption at each location.

11. Liability

11.1 Big Sky Picnics is not responsible for any injury, loss, or damage to persons or property during the picnic. The customer assumes all risk and liability associated with the event. Big Sky Picnics shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the picnic, including but not limited to property damage, personal injury, or loss of revenue.

11.2 The customer agrees to indemnify, defend, and hold Big Sky Picnics harmless from any and all claims, demands, causes of action, damages, liabilities, costs, and expenses, including reasonable attorney’s fees arising from or related to the picnic.

12. Force Majeure

12.1 Big Sky Picnics shall not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these terms and conditions caused by events outside its reasonable control (a “Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond our reasonable control. It includes (but is not limited to) such things as war, riot, fire, flood, earthquake, natural disasters, governmental actions, and other similar events.

12.2 In the event of a Force Majeure, Big Sky Picnics will try to reschedule the event but cannot guarantee availability on a specific date. If rescheduling is not possible, any fees paid will be refunded.

13. By booking your picnic, you are accountable for understanding and agreeing with these terms.

14. We reserve the right to modify, update, or change these terms and conditions at any time without prior notice. By using our services, you agree to abide by the most current version of these terms and conditions. It is your responsibility to check for updates regularly.
